Women sues Apple oer iPhone price cut for $1mil

SAN JOSE, Calif. - A New York woman is so angry at Apple Inc. for lopping $200 off the price of the iPhone that she's filed a lawsuit seeking $1 million in damages.

Dongmei Li of Queens, N.Y., claimed the company violated price discrimination laws when it slashed the price of the 8-gigabyte iPhone by a third, from $599 to $399, within two months of the gadget's June debut.

Apple lowered the iPhone's price on Sept. 5 and also said it would stop selling the $499 4-gigabyte model. Hundreds of early customers who paid full price didn't expect a reduction so soon and complained.

Apple issued an apology the next day. Under its return policy, Apple refunded the $200 difference for those who bought the phone within 14 days of the reduction. And in a move to make peace with those who purchased the higher-priced phone before that period, the company offered a $100 credit at Apple stores.

According to Li's lawsuit, filed on Sept. 24 in the U.S. District Court, Eastern District of New York, the price reduction injured early purchasers like herself because they cannot resell the product for the same profit as those who bought the cell phone following the price cut.

Li purchased a 4GB iPhone for $499 and alleged that owners of the 4GB model were given less favorable terms than those who bought the 8GB model at the premium price, according to the lawsuit.

Apple spokeswoman Susan Lundgren declined to comment, citing the company's policy to not discuss pending litigation.

The lawsuit also named AT&T Inc., the exclusive carrier in the U.S. for the iPhone, and alleged the two companies' required two-year service contract for the iPhone constituted unfair business practices.

Mark Siegel, an AT&T spokesman, declined to comment, saying he had not yet seen the lawsuit.

T-Mobile Feels the Samsung Beat

T-Mobile announced the availability of the Samsung Beat today. The SGH-t539 Beat is a quad-band GSM/EDGE, music-oriented flip phone. It has stereo Bluetooth as well as stereo speakers and a 1.3 Megapixel camera. It comes with a 1GB microSD card that is preloaded with two songs, but will support up to 2GB in the slot. It is compatible with T-Mobile's MyFaves program and goes on sale today.

Today Nokia announced that it is going to buy digital mapping company Navteq. It will pay $78 per share, amounting to a total price of $8.1 billion in a mix of cash and debt. With location-based services becoming an increasingly important part of the mobile market, Nokia expects this acquisition to help it offer better integrated map-based applications on its mobile devices. The acquisition will not effect Navteq's existing customers and Navteq will continue to operate independently. The deal, Nokia's largest ever, has already been approved by both companies' boards and is expected to close in early 2008.

At an event in London today, HTC showed off its fall lineup of Windows Mobile 6 smartphones.

  • Touch Dual: The Dual takes the Touch a step further by incorporating 2100 MHz HSDPA 3.6Mbps and a slide out keypad, making it a dual slider. It has the same TouchFLO interface as the Touch and adds the ability to view and manipulate slideshows with controls found on the touch screen. The Dual has also updated the usability of the touch screen for interacting with web pages and other productivity apps. It has a 2 Megapixel camera and microSD slot for storage. The Touch Dual is tri-band GSM/EDGE and will be available in Europe only.
  • S730: This update to the S710 brings a number of changes, including a faster 400 MHz processor and 2100 MHz HSDPA 3G. It has a similar slide out QWERTY design, quad-band GSM/EDGE, Wi-Fi, and Bluetooth 2.0 as well.
  • P6500: The P6500 takes aim at business users with its Windows Mobile 6 Professional backbone. It has a large 3.5-inch screen and a 3 Megapixel camera with autofocus. It also has integrated GPS, tri-band HSDPA, Wi-Fi, Bluetooth 2.0, and a fingerprint scanner for security. It has two SD card slots, and comes with up to 1GB of internal memory.

NEW Blackberry for Sprint and or Verizon


Research In Motion today announced the Pearl 8130, a new Blackberry for CDMA networks. The 8130 updates the Pearl with new features and new software in the same familiar body. The 8130 is the first Blackberry to launch with a new OS that features a mini-map in the Browser, new font rendering technology, and updated applications including the Inbox. It also upgrades the camera to 2 Megapixels while maintaining stereo Bluetooth, a 3.5mm headset jack and MicroSD slot. It will be available from CDMA carriers next month, though no carriers have announced the phone as of yet.
